New Delhi. The Delhi High Court has directed the Bar Council of Delhi (BCD) to take action against lawyer Sanjay Aggarwal for allegedly violating the order passed by the Intellectual Property Appellate Board (IPAB) in 2016.
The court acquitted the clients who had hired the lawyers, provided they tendered an unconditional apology for any inconvenience caused, undertaking to be careful while filing documents in future judicial proceedings.
The suo motu criminal contempt petition arose when doubts were raised over the authenticity of the IPAB order during proceedings before a single judge dealing with trademark infringement suits.
The court directed an investigation, and referred the case to a division bench for contempt action against the respondents after finding no records to support the existence of the 2016 order.
In response, an unconditional apology affidavit was submitted by the contemnor outlining the circumstances of obtaining the copy of the order from the counsel appointed before the IPAB.
It was clarified in the affidavit that the lawyer gave a copy of the IPAB order, when it was found to be fake, the contemnor filed a complaint against the lawyer in the Bar Council of Delhi.
The bench acquitted the clients, taking into account the apology and undertaking to be careful in future, but directed the Bar Council to take appropriate action against the lawyer if found guilty in fabricating the IPAB order.
