The annoying accordionist generates a dispute with the neighbor which becomes increasingly bitter until the inevitable complaint for threats and counter-complaint for slander. Result: the police arrive and seize the weapon.

The noisy musician, in fact, had a gun license and his rifle legally held in the apartment raised fears of a possible tragic epilogue, one of those unfortunately too often reported in the news in recent years.

The story happens in Genoa and sees the musician-hunter legally succumb before the TAR judges.

The administrative court in fact rejected his appeal, presented by the lawyer Adriano Vassallo, thus confirming the provisions of the Prefect on the ban on possession of weapons and of the police commissioner regarding the revocation of the license to carry the hunting rifle. The sentence reconstructs the events.

Starting from the «argument between the appellant and an apartment neighbor originating from sound emissions produced by the appellant’s accordion, a situation which created tensions in the relationships between these individuals living in the same condominium. In fact, this dispute gave rise to a criminal complaint lodged by the neighbor for the crime of threats and a complaint lodged by the appellant for slander, with consequent critical issues in interpersonal relationships which have not yet been resolved”. The accordionist asked for the measures to be annulled. also by virtue of the dismissal of the complaint for threats.

But the judges noted that “the absence of serenity and indeed of continuing conflict” between the two neighbors was noted and therefore it did not fail to justify a measure which has a preventive nature and not a sanction.

Epilogue: no rifle, but he can continue to hit with the accordion.
