The privacy guarantor has given the green light to the draft decree of the Minister of Infrastructure and Transport, in agreement with the Minister of the Interior, on the methods for placing and using speed cameras.
‘In the version of the scheme being examined by the authority – we read in the note informing of the green light – the observations provided by the guarantor’s office during the investigation were taken into account to make the decree compliant with privacy legislation’.

Images only on request
As requested by the guarantor, the images that constitute a source of evidence for violations of the highway code must not be sent to the home of the owner of the vehicle with the report notifying the violation. The photographic or video documentation must be made available to the recipient of the report only upon request, ensuring, in any case, that third parties and license plates of any other vehicles recorded are appropriately obscured or made unrecognizable.
Privacy blinds
In respect of the privacy of motorists, the use of speed detection systems that record the front of the vehicle is also permitted, but only if they are equipped with a function that automatically obscures the images of the people on board. Furthermore, the devices and recording systems, although capable of continuously monitoring traffic, will only store the images in the event of an infringement. Finally, the decree defines the retention times of the images and videos collected by the traffic police bodies. These are kept for the period of time strictly necessary for the application of fines and the settlement of any dispute.
