DPVAT: Chamber approves project that recreates mandatory insurance – 04/09/2024 – Daily Life

The plenary of the Chamber of Deputies approved on Tuesday night (9) a complementary bill authored by the Executive that recreates the DPVAT, insurance that compensates victims of traffic accidents, which had payment (until then mandatory for owners of vehicles) extinguished during the government of Jair Bolsonaro (PL).

Despite this, coverage for users continued to be provided, until the resources of the fund administered by Caixa Econômica Federal were exhausted last year.

This Tuesday, there were 304 votes in favor and 136 against. Opposition parliamentarians criticized the matter. As it was a PLP (complementary bill), an absolute majority of votes was required (257 of the 513 deputies). The text now goes to the Senate.

The approved matter determines that Caixa will be the insurance operating agent. The entity must create and manage a private fund designed to ensure the payment of compensation.

The text determines that the insurance will be annual and its coverage will include compensation for death and compensation for permanent disability (total or partial), the values ​​of which will be established by the National Council of Private Insurance (CNSP). The proposal does not establish the value of fees and compensation paid—it will be up to the council to determine “the maximum amounts and reimbursable expenses”.

The matter underwent a series of changes by the rapporteur, deputy Carlos Zarattini (PT-SP). Among them is a device that was included and allows the government to anticipate the expansion of the 2024 spending limit and, in practice, release extra expenses estimated at around R$15 billion.

Zarattini included in his opinion the possibility of reimbursement coverage for expenses with medical and supplementary assistance that are not provided by the SUS (Unified Health System), such as physiotherapy, medicines and prosthetics.

He also included a rule that provides for the transfer to municipalities and states, “where there is a municipal or metropolitan public transport service”, of 35% to 40% of the amount collected from the DPVAT fund. Furthermore, it determined that victims of accidents that occurred between January 1, 2024 and the entry into force of the law are covered by the compensation paid this year.

At the end of March, deputies approved the project’s urgency request, allowing it to be analyzed directly in plenary — without going through the thematic committees. The matter was discussed by parliamentarians, but given the low quorum due to the proximity to the Easter holiday, the president of the Chamber, Arthur Lira (PP-AL), suggested that it be considered at another time.
