Lawyers for the soldiers who refused to board the NRP Mondego will challenge the suspension

Lawyers for the 13 soldiers, who refused to board the Ship of the Portuguese Republic (NRP) Mondego, will challenge the suspension of the sailors, between 10 and 90 days, leaving open the possibility of taking the case to the European Court.
Upon leaving the Navy’s Legal Directorate, in Lisbon, where the decision was made public, lawyer Paulo Graça explained, quoted by Lusa, that: “We had no expectations, because we were not notified of the sanction that would be foreseeably applicable, in fact this will be one of the grounds for the challenge.”
The lawyer understands that there were different decisions for the 13 sailors, which will imply “different ways of challenging”. “There will be an appeal that must be imposed on the Chief of Staff of the Navy in relation to two [sargentos]” he warned.
António Garcia Pereira, another of the lawyers, assured that an appeal will be made to the courts of law, against the two sergeants who were punished with 60 and 90 days, adding that there is the possibility of taking the case to the European Court of Human Rights.
“The European Court encompasses the 13, because (…) the decision taken following a public hearing affects them all”, he explained.
The Portuguese Navy announced, this Thursday, the suspension of 13 soldiers, for 10 and 90 days, who refused to board the NRP Mondego, in March last year.
