Maintenance of the Chiquinho Brazão prison depends on approval from the

After federal deputy Chiquinho Brazão (União Brasil-RJ) was arrested in the Federal Police (PF) operation that arrested those responsible for the murder of councilor Marielle Franco (PSOL), the president of the Chamber of Deputies, Arthur Lira (PP-AL) , published a note indicating the rite that should take place from now on. Brazão was preventively arrested in the same action that targeted Domingos Brazão, advisor to the Court of Auditors of the State of Rio de Janeiro (TCE-RJ), and delegate Rivaldo Barbosa, former head of the Civil Police of Rio de Janeiro.

As he is a federal deputy, Chiquinho Brazão will depend on the decision of the Chamber plenary on the maintenance of the prison. By determination of article 53 of the Federal Constitution, federal parliamentarians can only be arrested if a non-bailable crime is committed. Because of this, the records of the case involving Brazão must be sent to the House within 24 hours, therefore, by this Monday (25).

“In the latest precedents (Wilson Santiago and Daniel Silveira), the presidency notified the arrested deputy that the arrest would be considered in the next session,” said Lira, citing the cases of Wilson Santiago (Republicanos-PB) and Daniel Silveira (no party- RJ). The step forward is the presentation of an opinion from the Constitution and Justice Commission (CCJ) directly in plenary due to the urgency of the issue. The arrest will be maintained if, when the report is put to a vote, the absolute majority of members are in favor of the arrest.

Lira clarified that the rite in the plenary includes three speeches from the defense, each lasting 15 minutes, which must occur before the reading, after the reading and after the discussion. The president added that voting will be open and that a resolution with the result should then be promulgated.

Also this Sunday, the Psol bench released a statement indicating that it will request Brazão’s impeachment from the Chamber’s Ethics Council. “Parliamentary immunity cannot become impunity for regret”, said, in a note, deputy Chico Alencar (RJ), party leader on the board.

The leader of Rede na Casa, Túlio Gadêlha (PE), asked the presidency of the Chamber to block the payment of Brazão’s salary and the parliamentary quota, which corresponds to the amount of public funds allocated to spending on the mandate, such as transport, material office space, accommodation prices, among others. “We are seeking the institutional guarantee that public money is not used against the principles of republican ethics. We expect common sense from the Presidency of the House in considering this case”, said Gadêlha.

The arrest of those responsible for the murder of Marielle Franco, who also killed the driver Anderson Gomes, had repercussions among different authorities in the country and some names in the Chamber as well. The leader of the PT bench, Odair Cunha (MG), for example, said that “today is an important day, which marks another advance in the investigations to identify and punish the murderers and those who ordered the execution of Marielle and Anderson Gomes”.

“The advancement of investigations, carried out by the Federal Police, reinforces that it is essential to have a free democracy, in which institutions function unhindered, without constraints and influence from anyone.
