The Compensa Society rejected the application for payment due to the fact that “the fault of any of the participants in the collision could not be determined.” – This is a scandalous decision – says attorney Łukasz Kowalski, representative of the relatives of the family who died in the accident.
The lawyer applied for compensation for the death of their son on behalf of the deceased Patryk’s parents. It seemed that the matter was obvious and there would be no problems with the payment of funds. However, it turned out that the insurer did not intend to transfer any money for now! The company’s translation is incomprehensible. It refers to the fact that at this stage it is impossible to clearly determine who caused the accident.
However, the attorney for Patryk’s parents emphasizes that he did what he could. – I applied to the insurance company for compensation for the parents of the Kia driver. I have attached documents from the preparatory proceedings files to the extent possible. The most important issue for the insurer was taken into account, i.e. the exclusion of the fault of the Kia driver – says Fakt.pl attorney Łukasz Kowalski.
When will they pay out money from Sebastian M.’s third party liability insurance?
Unfortunately, the answer was negative. – The insurer refused to pay even part of the compensation. The company’s justification is laconic, unempathetic and scandalous – emphasizes the representative of Patryk’s parents. The insurer hides itself by not knowing who the possible perpetrator of the accident is. – The insurer’s answer is “no, because no” – says the lawyer in an interview with “Fakt”. He disputes the claim that it is impossible to identify the guilty person.
Compensa also did not agree to pay the so-called the undisputed amount, i.e. the basic amount paid by the insurer without the injured party’s intervention. This amount is usually underestimated and is part of the compensation due for which you can still claim. Information about the accident, expert opinions, and prosecutor’s findings exist in the public sphere. Charges were presented in absentia. And the insurer doesn’t seem to see it

According to our interlocutor, this attitude of the insurer will make the entire process of paying compensation last even years. And the families of the tragically deceased family already had to incur considerable expenses related to, for example, the funeral and the settlement of the companies run by Patryk and Martyna. For poor families, this is a considerable expense.
If the company wants to wait until the end of the process, it may turn out that Patryk’s parents will receive the money only in a few years. All the more so because for now it is not even possible to indicate when Sebastian M. will be transported to Poland. The man refuses extradition, which prolongs the procedure.

The accident occurred in mid-September on the A1 motorway near Piotrków Trybunalski. Sebastian M. was driving his car at a speed of over 300 km/h. According to investigators, he hit a Kia in which a family of three was traveling. Her car burst into flames. The parents and their son died. Sebastian M. left the country before he heard the charges. That’s why they were brought against him in absentia. Ultimately, the man was arrested in Dubai, United Arab Emirates. He is currently in custody there, and the Polish side is carrying out extradition proceedings.
