JAKARTA, BALIPOST.com – The Honorary Council of the Constitutional Court (MKMK) decided that Constitutional Justice Anwar Usman was proven to have violated the Code of Ethics and Behavior of Constitutional Judges. This decision was read by the Chairman of the MKMK I Dewa Gede Palguna in the Plenary Session to Pronounce the MKMK Decision at the Constitutional Court, Jakarta, Thursday (28/3).
Quoted from the Antara News Agency, Palguna said that Anwar was proven to have violated the Code of Ethics and Behavior of Constitutional Judges as stated in the principles of Appropriateness and Decency in the application of points one and two of the Sapta Karsa Hutama. Based on this decision, Anwar Usman was sentenced to a written warning by the MKMK.
It is known that Anwar was reported to the MKMK by lawyers Zico Leonardo Simanjuntak and Alvon Pratama Sitorus and Junaidi Malau regarding his statement at a press conference regarding his objection to the ethical sanctions imposed by the MKMK in Decision No.2/MKMK/L/2023, namely the removal from office of the Chief Justice of the Constitutional Court. .
Anwar also filed a lawsuit with the State Administrative Court (PTUN) against the decision to appoint the new Chief Justice of the Constitutional Court for the 2023-2028 term of office, Suhartoyo.
MKMK member Yuliandri said that the main concern for the judges was Anwar’s attitude as the Reported Judge who was unable to accept the MKMK’s decision by holding a press conference.
“In the press conference, the Reported Judge openly conveyed to the public which was covered by various media, especially regarding his objections regarding procedural procedures, the considerations of the Panel of Judges, and sanctions,” said Yuliandri.
Institutionally, this action has a direct or indirect influence on the dignity and dignity of the Constitutional Court because the submission of objections is carried out openly.
Apart from that, for MKMK, Anwar’s lawsuit to the PTUN is a fact that strengthens the fact that he cannot accept the decision, and even reacted and resisted.
In the panel’s view, Anwar’s non-acceptance was a violation of the principles of the Code of Ethics and Behavior for Constitutional Judges.
“Therefore, the Honorary Council considers it necessary to give a written warning to the Reported Judge to show its sincere compliance with the Honorary Council’s decision, in casu Decision No.2/MKMK/L/2023,” concluded Yuliandri. (kmb/balipost)
