KPU Officially Files an Appeal Regarding Postponed 2024 Election Verdict

JawaPos.com – The General Election Commission (KPU) has officially filed an appeal against the decision of the Central Jakarta District Court Number 757/Pdt.G/2022/PN.Jkt.Pst dated March 2, 2023. The decision regarding the postponement of the 2024 elections.

The appeal was marked by the issuance of the Deed of Appeal Statement by the Central Jakarta District Court Number 42/SRT.PDT.BDG/2023/PN.JKT.PST dated 10 March 2023.

“Apart from declaring an appeal against the Central Jakarta District Court decision, the KPU has also submitted a Memorandum of Appeal to the Central Jakarta District Court Decision Number 757/Pdt.G/2022/PN.JKT.PST,” said KPU member Mochammad Afifuddin in a written statement, Saturday (11 /3).

Afifuddin added that the appeal statement made by the KPU against the Central Jakarta District Court decision is a form of the KPU’s seriousness in facing the lawsuit from the Adil Makmur People’s Party (Prima). The KPU is firmly against postponing the 2024 elections.

“Furthermore, the KPU is waiting for a decision from the Jakarta High Court Judge on the appeal filed,” he added.

The KPU submitted a memorandum of appeal through the Head of the Legal Advocacy and Dispute Resolution Bureau (AHPS) of the KPU General Secretariat, Andi Krisna at the Central Jakarta District Court. Andi explained that the KPU as a whole has submitted the entire appeal process and documents. “We have already submitted the documents, we have also received the Deed of Appeal,” he explained.

Previously, the Central Jakarta District Court granted a lawsuit filed by the Adil Makmur People’s Party (Prima), regarding a civil lawsuit over the results of verification of political party administration for the 2024 election. The Central Jakarta District Court punished the KPU for delaying the holding of the elections.

“Accepting the lawsuit of the plaintiff (Prima Party) in its entirety. Stating that the plaintiff is a political party that was harmed in the administrative verification by the defendant (KPU RI),” said the Central Jakarta District Court’s decision, Wednesday (2/3).

This decision was read out on Wednesday (2/3), by Chairman of the Panel of Judges T. Oyong with Judges Members of Bakri and Doweeks Silaban. Also, the substitute clerk for Bobi Iskandardinata.

The Central Jakarta District Court asked the KPU as the defendant not to continue the process of the 2024 election stages. Thus, the KPU was asked to postpone the holding of the 2024 elections.

“Punish the defendant not to carry out the remaining stages of the 2024 General Election, since this decision was pronounced and carry out the General Election stages from the beginning for approximately 2 years 4 months 7 days,” requested the Central Jakarta District Court Judge.

In addition to postponing the process of the election stages, the Central Jakarta District Court also asked the KPU as the defendant to pay compensation of Rp. 500 million to the plaintiff, in this case the Prima Party.
