TNI Commander: Filling ASN Positions by Soldiers at the Ministry’s Request

REPUBLIKA.CO.ID, JAKARTA — TNI Commander General Agus Subiyanto responded to the draft government regulation (RPP) mandated by Law Number 20 of 2023 concerning State Civil Apparatus (ASN). One of them regulates the filling of ASN positions by TNI soldiers.

He explained that filling ministries/institutions from TNI soldiers had previously been regulated in Minister of Defense Regulation (Permenhan) Number 38 of 2016. It stated that TNI soldiers could fill positions in 10 ministries.

“In the course of time, there have been several ministries that have made MoUs with the TNI. For example, PUPR, PUPR wants an example of making roads in Papua or airfields, the MoU must be with the TNI,” said Agus in a working meeting with Commission I of the DPR, Thursday ( 3/21/2024),

“Kominfo for BTS, 100s of BTS in Papua also has an MoU with the TNI for security. Then there is also an MoU with BUMN with the TNI regarding the security of vital national objects,” he continued.

Based on the regulations derived from the ASN Law, there are a number of requirements for TNI soldiers to fill ASN positions. One of them is at the request of the ministry/institution, not the TNI who submitted it.

“So if there are TNI personnel in the ministry it is based on a request from the ministry based on the needs I mentioned earlier. So the aim is the needs of the ministry,” said Agus.

It is known that there are six points of requirements for filling ASN positions from TNI soldiers and Polri members. First, only for certain ASN positions at certain central agencies.

Second, TNI soldiers and Polri members who hold ASN positions at central agencies cannot change their status to ASN. Third, filling ASN positions specifically for TNI soldiers and Polri members who are the best talents.

Fourth, must meet educational qualifications, competence, rank, education and training. As well as track record, relevant positions, health, integrity and other position requirements.

Fifth, the rank is at least equivalent to the level of the ASN position to be held according to the minister’s approval, and the age is at most one year before the TNI-Polri retirement age limit. Finally, it is carried out through a talent management mechanism if there is a need.
