Yosua Murder Case, Agus Nurpatria Sentenced to 2 Years in Prison

JawaPos.com – Defendant Agus Nurpatria was sentenced to 2 years in prison by the Panel of Judges at the South Jakarta District Court. The former subordinate of Ferdy Sambo is considered legally and convincingly guilty of obstructing investigators in the murder case of Brigadier Nofriansyah Yosua Hutabarat alias Brigadier J.

“Stating that the defendant Agus Nurpatria has been legally and convincingly proven guilty of committing a crime. Sentenced the defendant Agus Nurpatria to be sentenced to 2 years in prison,” said Chief Justice Ahmad Suhel during the trial at the South Jakarta District Court, Monday (27/2).

Agus was proven to have violated Article 48 in conjunction with Article 32 of the Electronic Information and Transaction Law (UU ITE) in conjunction with Article 55 paragraph 1 1 of the Criminal Code. Agus was also fined Rp. 20 million, a subsidiary of 3 months in prison.

Previously, Agus Nurpatria was prosecuted for 3 years in prison in the murder case of Brigadier Nofriansyah Yosua Hutabarat alias Brigadier J. He was found guilty of committing an obstruction of justice violation or obstructing an investigation.

“Declaring that the Defendant Agus Nurpatria has been proven and guilty of committing a criminal act, who committed, ordered to commit, and took part in committing an act intentionally without rights or unlawfully committed an act which resulted in the disruption of the electronic system so that it does not work properly as it should violate Article 49 in conjunction with Article 33 Law No. 19 of 2016 concerning amendments to Law No. 11 of 2008 concerning Information and Electronic Transactions in conjunction with Article 55 paragraph (1) 1st of the Criminal Code,” said the Public Prosecutor (JPU) in a hearing at the Jakarta District Court South, Friday (27/1).

“Sentenced a sentence against Defendant Agus Nurpatria with a sentence of 3 years in prison minus the detention period and an order to remain in custody. Imposing a fine of Rp. 20 million, a subsidiary of 3 months in prison,” he added.

The things that incriminated Agus were that the defendant’s actions were not appropriate because they were contrary to his position and his obligation to act in accordance with the provisions of the law in uncovering the loss of the victim’s life. The defendant’s actions had asked the witness Irfan Widyanto to secure the CCTV of the Duren Tiga complex number 46 without a valid warrant. And the defendant’s actions have tarnished the Polri institution.

Meanwhile, the mitigating factors were that the defendant had served for more than 20 years as a member of the National Police, while carrying out his duties the defendant had never committed a disgraceful act, and the defendant was polite in court.
