Yosua Murder Case, AKBP Arif Rahman Sentenced to 10 Months in Prison

JawaPos.com – Defendant Arif Rahman Arifin who is a former Wakaden B of the Bureau of Administrative and Propagation of the National Police was sentenced to 10 months by the Panel of Judges at the South Jakarta District Court. He was found guilty of committing an obstruction of justice violation in the murder case of Brigadier Nofriansyah Yosua Hutabarat alias Brigadier J.

“Declaring that the defendant Arif Rahman Arifin has not been proven legally and convincingly guilty in the first primary charge. Therefore acquitting the defendant from the primary indictment,” said the presiding judge in court, Thursday (23/2).

“Declaring that the defendant Arif Rahman Arifin has been legally and convincingly proven guilty of committing a criminal act intentionally and against the law in any way damaging a public electronic information which was carried out jointly. For that reason, the defendant was sentenced to imprisonment for 10 months and a fine of Rp. 10 million with the stipulation that if the fine is not paid, it will be replaced with imprisonment for 3 months,” he added.

What is aggravating is that the defendant’s actions contradicted the principles of professionalism that apply as members of the Indonesian National Police. Meanwhile, the mitigating factors for the defendant have never been convicted, the defendant has family dependents, the defendant was polite and cooperative so that the disclosure of the shooting incident of Brigadier Yosua Hutabarat became clear.

Arif Rahman was found guilty of violating Article 49 in conjunction with Article 33 of Law No. 19 of 2016 concerning amendments to Law No. 11 of 2008 concerning Information and Electronic Transactions in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.

Previously, the defendant Arif Rahman Arifin was charged with 1 year in prison in the obstruction of justice case for the murder of Brigadier Nofriansyah Yosua Hutabarat alias Brigadier J. Arif who was found guilty of complicating the process of uncovering the Yosua murder case.

“Declaring that the Defendant Arif Rachman Arifin has been proven to have committed a crime, those who committed, ordered to commit, and took part in committing an act intentionally without rights or against the law committed an act which resulted in the disruption of the electronic system so that it did not work properly as it should violate Article 49 in conjunction with Article 33 of the Law -Law No.19 of 2016 concerning amendments to Law No.11 of 2008 concerning Information and Electronic Transactions in conjunction with Article 55 paragraph (1) 1st of the Criminal Code,” said the Public Prosecutor (JPU) in a hearing at the South Jakarta District Court , Friday (27/1).

“Determined the defendant Arif Rachman Arifin with a sentence of 1 year in prison minus the detention period and an order to remain in custody. Imposing a fine of Rp. 10 million, a subsidiary of 3 months in prison,” he continued.

The things that aggravating this charge are the actions of the defendant in the form of asking the witness Baiquni Wibowo so that the recording files related to Nofriansyah Yosua Hutabarat are still alive and by walking into the official residence of the witness Ferdy Sambo Number 46 to be deleted, then damaged or broken the laptop which has a copy records of criminal acts. So it can’t work or function anymore.

The defendant knew very well that the electronic system evidence was very useful in uncovering the criminal act of Yosua’s murder. The defendant took security measures to be handed over to those who have authority, namely investigators.

The defendant’s actions violated the electronic proof system security procedures related to criminal acts, where the act was not supported by a valid warrant.

While the mitigating factors are that the defendant openly admits his actions, the defendant regrets his actions, the defendant is still young and is expected to be able to improve himself.
