Direct speech of Venislavskyi: “Article 108 of the Constitution of Ukraine gives an unambiguous answer to this question, and in an imperative aspect. It says that the president continues to exercise his powers until the newly elected president of Ukraine takes office. This is an unambiguously binding norm that the president must fulfill.”

Details: According to him, all parliamentary factions have signed an agreement that no elections can be held in Ukraine until the end of martial law. He also added that such practice contradicts international norms.
“All, without exception, international authoritative institutions dealing with election issues, the International Foundation for Electoral Law, for example, have drawn attention to the fact that elections cannot be held during martial law,” he added.
Venislavsky noted that one of the reasons for refusing to hold elections under the current conditions is the risk of non-compliance with voters’ rights throughout Ukraine.
“For me, as a constitutionalist, it is obvious that it is impossible in principle to adhere to the constitutional principles of holding any elections – whether local, parliamentary, or presidential. And therefore, they cannot be held, since we will not provide the citizens of Ukraine with the opportunity to participate in the elections with observance of all the rights of all the subjects of the electoral process,” the People’s Deputy emphasized.
What happened before:
- On February 27, the publication ZN.UA wrote that the Office of the President has prepared the text of an appeal to the Constitutional Court regarding the legitimacy of Volodymyr Zelenskyi’s tenure as President of Ukraine, given that his term of office expires this spring, but has not yet submitted it.
- According to the plan of the leadership of the OP, if a decision is made to appeal to the Central Committee of Ukraine with such a constitutional submission, it will be done by people’s deputies from “Servant of the People”. However, the appeal has not yet been delivered to the deputies of the presidential faction.
